DETERGENTS IN UKRAINE: ENSURING LEGISLATIVE COMPLIANCE – A CHALLENGE FOR MANUFACTURERS AND IMPORTERS

The Ukrainian market for detergents is rapidly evolving, offering consumers a wide range of products. However, behind this diversity lies a complex system of legislative requirements aimed at ensuring product safety, protecting human health, and the environment. For manufacturers and importers of detergents in Ukraine, it is critically important to understand and comply with these requirements to avoid sanctions and ensure the successful operation of their business.

KEY LEGISLATIVE ACTS REGULATING THE DETERGENTS MARKET INCLUDE:
· Technical Regulation on Detergents (TRD): Establishes definitions, requirements for composition, physico-chemical properties, testing methods, and labeling rules.
· Technical Regulation on Classification, Labeling, and Packaging of Chemical Products (CMU Resolution No. 539 of 17.07.2024): Implements the principles of the CLP Regulation. Establishes requirements for hazard identification, classification, safety data sheets (SDS), and labeling.
· Technical Regulation on the Safety of Chemical Products (CMU Resolution No. 847 of 23.07.2024): Implements REACH principles and sets out general requirements for chemical safety.
· Procedure for State Registration of Hazardous Factors (CMU Resolution No. 588 of 21.05.2025): Introduces state registration of chemical substances and hazardous factors, including those contained in chemical products. Registration is carried out through the Register of Hazardous Factors, which is to be operational from July 1, 2025.

WHAT MARKET OPERATORS MUST CONSIDER FIRST:
1. High-quality development of formulations and raw material quality control:
o Compliance with TRD regarding content of surfactants, phosphates, and biodegradability.
o Incoming quality control of raw materials, obtaining safety documentation – MSDS and quality certificates.
2. Product testing:
o Determination of pH, density, surfactants, phosphates, microbiology, biodegradability, etc. according to TU or regulation.
o Tests must be performed in manufacturer’s and accredited laboratories.
3. Development of a Safety Data Sheet (SDS):
o Mandatory for each product.
o In accordance with Resolutions No. 539 and No. 847 and GHS requirements.
o Language – Ukrainian, with mandatory updates when product data or legislation changes.
4. State registration of hazardous factors:
o From July 1, 2025, all hazardous chemicals (or those released from products with a concentration ≥10%) must be registered in the Register of Hazardous Factors.
o Application submission, expert review, and entry into the register are the responsibility of the manufacturer or importer.
5. Product labeling: Must comply with TRD + Resolutions No. 539 and No. 847. Must include:
o Product name and intended use
o Composition (according to classification)
o Hazard (H) statements, precautionary (P) statements, GHS pictograms (if required)
o Date of manufacture, batch number
o Instructions and dosage
o Conformity mark (if conformity assessment is conducted)
6. Declaration of conformity:
o For TRD, if the content of surfactants is ≥0.2%, a declaration from an accredited body is mandatory.
7. Publication of the technical description of ingredients in accordance with TRD:
o Manufacturers of detergents must publish a technical description of ingredients on their website.
