   Notification of cosmetic products in Ukraine

Notification of cosmetic products in Ukraine is a multi-stage process that requires advance preparation. The notification process requires manufacturers and importers to confirm compliance of production with Good Manufacturing Practice (GMP) and safety requirements.

Manufacturers and importers must undergo the notification procedure before introducing cosmetic products to the market. This procedure is a mandatory part of regulatory control in the cosmetics industry.

The Technical Regulation (TR) for cosmetic products is based on Regulation (EC) No 1223/2009 on cosmetic products dated November 30, 2009, and in accordance with Cabinet of Ministers Resolution No. 65 of January 20, 2021. The TR comes into effect on August 3, 2024.

The placing on the market of cosmetic products that comply with this Technical Regulation cannot be prohibited or restricted. The placing on the market of cosmetic products that were placed on the market before August 3, 2026, cannot be prohibited or restricted due to non-compliance with the requirements of this Technical Regulation.

 

Cosmetic products may be placed on the market if a "responsible person" is designated for them. Providing cosmetic products on the market must include mandatory indication of information about the responsible person, their name, and location on the product.

 

The requirements of the Technical Regulation (TR) for the Responsible Person include the following:

  1. Ensuring safety assessment based on a comprehensive set of evidence from all sources using available information.

  2. Conducting analyses using reliable and reproducible methods defined by national standards identical to harmonized EU standards.

  3. Prohibition of animal testing for the final composition, ingredients, or their combinations, as well as for the final cosmetic product, using methods other than alternative methods.

  4. Using only safe colorants, preservatives, and UV filters in the production of the product according to the requirements specified in the TR.

  5. Keeping documentation for a period of 10 years from the date of placing the last batch on the market.

 

 

According to paragraph 25 of the regulation, safety assessment of cosmetic products is conducted by an expert who has obtained a higher education degree in "Medicine" (specialty 222) or "Pharmacy, Industrial Pharmacy" (specialty 226) at the master's level of higher education, or any other higher education recognized as equivalent by the Ministry of Education.

  • Develop and implement a management system in production that complies with the requirements of the DSTU EN ISO 22716:2015 standard for Cosmetics - Good Manufacturing Practice (GMP).

  • Ensure the conduct of testing on cosmetic products.

  • Carry out safety assessment and compile a safety report for cosmetic products.

  • Perform notification (submission) of information about cosmetic products on the respective electronic portal of the Ministry of Health, providing data on the cosmetic product.
