New Requirements for Dietary Supplements in Ukraine: Notification, Labelling, and Safety

The Law № 4122-IX, which came into effect on September 27, 2025, mandates compulsory notification and introduces updated requirements for product composition, labelling, and safety. Dietary supplements are food products that must comply with the safety, quality, and proper labelling requirements defined by the current legislation of Ukraine.
According to Article 1 of the Law of Ukraine "On the Basic Principles and Requirements for the Safety and Quality of Food Products," the definition of a dietary supplement is established as a food product that: is intended for consumption in small, specified quantities as a supplement to the usual diet, either alone or in combination with other food products; is a concentrated source of vitamins, minerals, or other substances with a nutritional or physiological effect; and is sold in a dosage form as a packaged food product in the form of capsules, lozenges, pills, sachets, ampoules with liquids, dropper bottles, or in other similar forms of liquids and/or powders.
Key Requirements for Dietary Supplements
To place a dietary supplement on the Ukrainian market, compliance with the following requirements must be ensured:
Composition: Only authorised vitamins, minerals, and biologically active substances in permissible doses, as approved by the Ministry of Health (MOH) of Ukraine, are allowed.
Labelling: Clear indication of the name "dietary supplement," the recommended daily amount, warnings, and precautions.
Health Claims: Only those claims that are consistent with the lists approved by the MOH of Ukraine and EFSA (European Food Safety Authority) are permitted.
New Legislation: Notification is Now Mandatory
The Law of Ukraine № 4122-IX "On Amendments to Certain Laws of Ukraine Regarding the Improvement of Regulation of Production and Circulation of Dietary Supplements..." came into force on September 27, 2025.
Key changes for manufacturers and distributors:
Mandatory notification of dietary supplements at least 10 working days before placing them on the market and commencing sales.
Updating the lists of permitted substances, including requirements for the use of Novel Foods, harmonised with EU legislation.
Clarification of maximum permissible doses of vitamins and minerals.
Uniform requirements for labelling and consumer information.
Transition Period
The Law provides a flexible transition for market operators:
For 1 year from September 27, 2025, the circulation of supplements manufactured under old regulations is permitted.
This product may remain in circulation until the expiration of its shelf life, but no longer than three years from September 27, 2025 (i.e., until September 27, 2028).
Crucial Deadline: Market operators already selling dietary supplements must notify them within 6 months from the date the Law entered into force (by March 27, 2026), if they plan to continue their circulation.
