Piperonal: How not to run into court cases. Challenges of import and regulation of piperonal/heliotropin (CAS 120-57-0) in Ukraine

Piperonal, also known as heliotropein (CAS 120-57-0), is a popular fragrance compound used in cosmetics and perfumes. Its pleasant odor, which is reminiscent of vanilla and almonds, allows piperonal to be widely used in various fragrance compositions, including air fresheners.

Piperonal has an important place in the fragrance industry, as it can be provided in low concentrations in a variety of products, including perfumes, cosmetics, household products, and even products used in the food industry. It is also found naturally in vanilla pods, heliotrope and lilacs.


However, the inadequacy of Ukrainian legislation has created serious difficulties for importers of piperonal in small quantities as part of other substances. According to the law “On the Circulation of Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors,” this compound is classified as a precursor, which restricts its circulation regardless of concentration. This means that companies that frequently import piperonal may face difficulties in the customs clearance process.


The case No. 760/14245/24, considered by the Solomyansky District Court in Kyiv, is a proof of this situation. In this case, a Ukrainian citizen representing a customs broker was brought to administrative responsibility for violating customs regulations by failing to declare piperonal in perfume compositions.


The court determined that piperonal was included in the list of restricted precursors, but failed to prove that its quantity exceeded the permissible limits or that its circulation was strictly controlled. The expert could not accurately determine the amount of piperonal because there was no standard sample for analysis. The court also noted that the declarant acted in accordance with supporting documents that did not mention piperonal.


As a result, the court closed the case due to the absence of an offense, emphasizing that all submitted customs documents were properly executed in compliance with the law.


This case emphasizes the importance of thoroughly checking the content of controlled substances in imported products. Companies operating in the fields of cosmetics and perfumery should be particularly attentive to the ingredients they use. Other examples of fragrance compounds that can cause similar problems are essential oils, synthetic flavors, aldehydes, and various carbonyl compounds.


Conclusion.

The situation with piperonal in Ukraine demonstrates the difficulties that companies may face in a changing regulatory environment. Problems in customs clearance and uncertainty in legislation require more attention and clearer formatting of regulations to maintain competitiveness and innovation in the cosmetics and perfumery sector. Compliance with legal requirements should be ensured, and updates to geographically relevant regulations should be monitored to avoid delays in supply and unforeseen financial losses.
